Robots4Autism Mobile App Privacy Policy

This privacy policy governs your use of the software application for mobile devices that was created by RoboKind LLC (“RoboKind”, “we”, and “us”) and is called Robot4Autism and RoboKind Social Skills (the “Application”). The Application is a mobile app for delivering lessons with a RoboKind robot. This privacy policy was last updated on July 6, 2022.

What information does the Application obtain and how is it used?

• User-Provided Information

The Application obtains the information you voluntarily provide when you download the Application, register with us, and use the Application. For example, you generally provide (a) your name, email address, age, user name, password, and other registration information; (b) transaction-related information, such as when you download or use the Application; (c) information you voluntarily provide us when you contact us for help with the Application or your use of the Application; and (d) information you voluntarily enter into the Application when using the Application, such as contact information.

• Automatically Collected Information

In addition to User-Provided Information, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile device’s operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

Does the Application collect precise real time location information of your mobile device?

The Application does not collect precise information about the location of your mobile device.

How do we use your information?

We use your information:

• as necessary to provide services or products you have ordered;
• as necessary to enforce our rights or to fulfill our obligations under any legal agreements that we have with you or any other party related to your use of the Application in combination with a RoboKind robot or any online service we provide, such as the terms of any Customer Agreement or any agreement for subscription services we offer;
• for statistical compilations, but we only do so by aggregating your information with other users’ information in such a way so that your identity and the other users’ identities cannot reasonably be determined from the resulting statistical compilations;
• to contact your from time to time to provide you with important information, required notices, and marketing promotions;
• as required by law;
• as necessary to protect the rights, safety, or property of RoboKind, its users, or others; and
• in any other ways described in this Mobile App Privacy Policy or to which you consent while using the Application.

If you also use a RoboKind robot or access and use our website or an online service provided by RoboKind, you may be subject to our RoboKind Website Privacy Policy as well.

Do third parties see and/or have access to your information obtained by the Application?

We will share your information with third parties only in the ways that are described in this privacy statement. We may disclose your information to third parties:

• as necessary to provide services or products you have ordered, such as by providing it to a carrier to deliver products you have ordered;
• as required by law, such as to comply with a subpoena, search warrant, or similar legal process;
• as necessary to protect the rights, safety, or property of RoboKind, its users, or others, which may include exchanging information with other organizations for fraud protection and/or risk reduction purposes;
• to our outside auditors who have agreed to keep the information confidential and to comply with the terms of this Mobile App Privacy Policy, and
• to any other parties specified in this Mobile App Privacy Policy or with whom you specifically consent to our sharing of your information for a specified purpose.

With respect to our services providers who work on our behalf to provide services or products you have ordered, such providers do not have an independent use of the information we disclose to them and have agreed to comply with the terms of this Mobile App Privacy Policy.

If RoboKind is involved in a merger, acquisition, or sale of all or a portion of its assets that relates to your information, you will be notified via email and/or a prominent notice on our website of any such change in ownership or uses of your information as a result of such change in ownership, as well as any choices you may have at that time regarding your information.

For clarity, the statistical compilations we may derive in part from your information are not subject to the foregoing list. Because the statistical compilations consist of only aggregated, anonymized information, we may disclose those statistical compilations to any third party, for example external services that we retain to help us improve the Application and our products and services.

What to do if you do not want your information collected or wish to stop collection of your information?

It is always up to you whether to disclose information to us, although if you elect not to do so, then you will be unable to use the Application for its intended purposes (i.e., in conjunction with a RoboKind robot or our subscription service). If you grant us consent to collect your information, but later wish to revoke that consent, then you can stop collection of your information by the Application at any time by uninstalling the Application from your mobile device. You may use the standard uninstall processes as may be available as part of your mobile device or via the applicable mobile application marketplace or network. Again, if you elect to revoke your consent to the Application collecting your information, then you will be unable to use the Application for its intended purposes (i.e., in conjunction with a RoboKind robot or our subscription service).

How long do we retain your information?

We will retain User-Provided and Automatically Collected Information for as long as you use the Application and until you request the deletion of your data. If you’d like us to delete User-Provided Information that you have provided via the Application, please contact us at support@robokind.com with your request. We will respond to your request within a reasonable time. Please note that some or all of the User-Provided Information is required in order to use the Application for its intended purposes (i.e., in conjunction with a RoboKind robot or our subscription service). If you request that we delete such User-Provided Information, then you will be unable to use the Application for its intended purposes. For the avoidance of doubt, we retain aggregated statistical compilations (i.e. non-personally identifiable data) for as long as we may elect.

Do we collect information from children?

User-Provided Information is not intended to be provided by children under the age of 13. Automatically Collected data is gathered in the Application in accordance with the Customer Agreement. We do not knowingly solicit data from or market to children under the age of 13 and expect that any information provided via the Application is provided by the adult facilitator. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at support@robokind.com. We will delete such information from our files within a reasonable time.

How do we protect your information?

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect the information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop, or improve our Application and products and services with which the Application is intended to interact. Please be aware that, although we endeavor to provide reasonable security for the information we process and maintain, no security system can prevent all potential security breaches.

Where is my information processed?

We operate in the United States, including for purposes of Processing information. “Processing” (and its derivatives, like “Processed”) means using or touching information in any way, including, but not limited to, collecting, transferring, storing, deleting, using, combining, and disclosing information, and includes using cookies on a computer/mobile device. If you reside outside the United States and use the Application, then your information will be Processed in the United States subject to the privacy laws of the United States. If you do not consent to your information being Processed in the United States, you are not authorized to and should not use the Application.

Your Consent

By using the Application, you consent to our Processing of your information as set forth in this Mobile App Privacy Policy. If you do not consent to this Mobile App Privacy Policy, you are not authorized to and should not use the Application.

We may update this Mobile App Privacy Policy.

This Mobile App Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Mobile App Privacy Policy by posting the new Mobile App Privacy Policy here and informing you via email and/or a prominent notice on our website. You are advised to consult this Mobile App Privacy Policy regularly for any changes because continued use of the Application after we post an updated Mobile App Privacy Policy is deemed your consent to the updated Mobile App Privacy Policy.
